This module introduces you to relevant English legislation and social policy underpinning health and social care practice. You will cover topics including: economic and political context of law and social policy; legislation and policy that applies to health and social care practice; the criminal justice system; work with children and families (including risk and safeguarding issues); work with adults (including risk and safeguarding issues); human rights; and political impact and influence upon law and social policy. The application of law and policy to the practice context will also be explored.
This module is designed to equip students with foundational level legal and social policy knowledge in areas of adult and children practice. You will examine law and policy frameworks that inform and mandate health and social care practice. In particular, you will explore aspects of English law and how this underpins and influences your practice. You will be introduced to the English legal system and the roles and responsibilities of social workers/social care workers within that system. By focusing on legislation, guidance, codes of practice and case law as it applies to social work and social care practice in relation to mental capacity, mental health, adult social care, equality and diversity, human rights and children and families, you will explore the complex relationship between ethics and law, and the impact of social policy on the range of duties and powers contained within the social work/social care role. You will gain an understanding of the social care safeguarding role in relation to both children and adults at risk of abuse or neglect, and that child needs are paramount within any practice situation. You will also explore the way in which social work and social care have developed as part of the welfare support system in England and critically engage with the inherent tensions in the changing social contract between citizen and state.
This module will provide MSci Social Work students with the underpinning knowledge that is required to meet the Chief Social Workers’ Knowledge and Skills Statements and BSc and MSci Health and Social Care students with the underpinning knowledge required to meet the National Occupational Standards for Health and Social Care.
