Activities providing opportunities for formative assessment will generally be integrated into the teaching and learning process and apply to all components of summative assessment.  The nature of the formative assessment tasks used will be at the discretion of the tutor, to include for example, workshop exercises, quizzes, group discussions.

The assessment of Employment Law and Practice is by way of a three hour examination

<p>On completion of this module, the student should have an appreciation of the nature of the key areas of employment law and practice and be able to deal with the more commonly encountered employment law problems and procedures whether acting for an employer or an employee.  The student will also have gained experience through practice of the key stages of the employment tribunal process.</p>

Employment Law and Practice (MLP)

Understand the qualification requirements for the presentation of statutory and non-statutory claims and understand the matters to be considered in connection with remedies and the calculation of compensation.

Draft documentation, including employment tribunal claim and response forms, discrimination questionnaires, compromise agreements and contractual documents in clear, correct language, using precedents where appropriate.

Investigate and identify the relevant facts relating to a client’s circumstances, research, identify and critically evaluate the relevant legal issues, and advise the client on the legal consequences.

Demonstrate a systematic understanding and critical awareness of current legal and related problems leading to a strategic approach to reaching a solution.

Identify the client’s reasonable expectations as to quality and timeliness of service.

Calculate compensation in employment tribunal cases.

Demonstrate their knowledge and understanding of Employment Law and employ applicable skills in the area of Employment law and practice.

Use the legal knowledge, skills, procedures and behaviours appropriate to each client and each matter.

Advise employers and employees on employment related problems and on possible courses of action available, their effect and how they can be financed.

Identify potential incidents of unlawful discrimination and have an understanding of the law relating to it.

4.	Understand the concept of redundancy and the law relating to the transfer of undertakings, and appreciate the importance of good procedure in such cases;

Prepare for the presentation of basic tribunal cases at contested hearings.

Conclude employment law cases through alternative means if appropriate, including by way of the raising of issues through disciplinary and grievance procedures, negotiation of settlements and the compromise of cases with the assistance of ACAS and through the use of formal compromise agreements.

Identify the overall nature of the matter presented by the client, then plan and progress that matter through a series of steps and decisions including, where appropriate, drafting documentation.	

Identify the client's goals in an employment dispute and alternative means of achieving those goals, demonstrate the ability to critically evaluate the range of means of achieving those goals, and deal appropriately with client care.

Understand the importance of determining whether an individual is or is not an employee and the effects of the distinction and appreciate the ways in which a contract of employment can be formed and the potential sources of terms.

Understand the concept of an unfair dismissal and the potentially fair reasons for dismissal.

Recognise and act within the rules of professional conduct.
