Activities providing opportunities for formative assessment will generally be integrated into the teaching and learning process and apply to all components of summative assessment.  The nature of the formative assessment tasks used will be at the discretion of the tutor, to include for example, workshop exercises, quizzes, group discussions.

<p>The aim of the module is to introduce the student to the needs of the business client and to give a broad overview of some of the main areas of work undertaken by the solicitor in commercial practice. The main areas covered are commercial contracting; intellectual property; competition law; commercial dispute resolution and payment mechanisms in commercial transactions.</p>

Commercial Law and Practice (MLP)

Identify the overall nature of the commercial transaction and plan and progress test transactions through a series of steps and decisions in appropriate circumstances including, where appropriate, drafting documentation.

Use the commercial legal knowledge, skills, procedures and behaviours appropriate to each client and each transaction or matter.

Understand the law in relation to the financial and business implications for the commercial client.

Demonstrate a systematic understanding and critical awareness of current legal and related problems leading to a strategic approach to reaching a solution.

Investigate and identify the relevant facts including knowledge of the client's business and business sector; research, identify and critically evaluate the relevant legal issues, and place them in commercial context appropriate to the client's needs.

Develop a case presentation strategy and agree a strategy with the client, taking into account all the commercial factors acting on the client's needs.

Demonstrate their knowledge and understanding of the Commercial context of the client’s business and employ applicable skills in the area of Commercial law and practice.

Understand the key features of the law as applied to commercial transactions.

Recognise and act within the rules of professional conduct.

Identify the client's goals and alternative means of achieving those goals, demonstrate the ability to critically evaluate the range of means of achieving those goals, and deal appropriately with client care.

Appreciate the professional and business context and standards governing commercial practice.

Identify the client’s reasonable expectations as to quality and timeliness of service.

Understand the need for preparation and the correct way to undertake it.

Draft documentation to affect the transactions in clear and unambiguous language and with correct grammar.

Understand the key features of modern commercial law statutes.
